EPA Cites Kop-Coat Inc. of Pittsburgh for Pesticide Violations

PHILADELPHIA – The U.S. Environmental Protection Agency today announced that it has cited Kop-Coat Inc. of Pittsburgh, Pa., for allegedly violating the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Kop-Coat manufactures protective coatings and wood treatments.

Under FIFRA, any pesticide product must be registered with EPA before it is distributed or sold, except under very limited circumstances. The registration requirements are designed to avoid unreasonable adverse effects on human health and the environment, to ensure proper labeling of pesticidal products, and to prevent false, misleading, or unverifiable claims about pesticides.

EPA has cited Kop-Coat for 34 violations of FIFRA’s prohibition on the sale or distribution of unregistered pesticide products. According to EPA, the company distributed and sold an unregistered pesticide product which was manufactured in the company’s St. Louis facility. The unregistered pesticide is a blend of two registered products, Woodlife® F Millwork Preservative and Timbertreat® 4 WT Insecticide Concentrate. Kop-Coat is no longer distributing or selling the unregistered blend.

FIFRA provides a statutory maximum penalty of $5,500 per violation.

The company may request a hearing to contest the alleged violations and proposed penalty, which will be determined after the company has had the opportunity to answer the complaint and provide additional information about the alleged violations.
