EPA Settles Clean Water Act Case Against Dlesk Realty for Filling Stream

PHILADELPHIA – Dlesk Realty and Investments, LLC, of Wheeling, W.Va. has agreed to pay a $5,000 penalty as part of a settlement with the U.S. Environmental Protection Agency over alleged violations of the Clean Water Act relating to the unlawful discharge of fill material into a stream during the construction of an industrial park.

EPA cited Dlesk Realty for violating regulations that require a permit from the U.S. Army Corps of Engineers before dredged or fill material may be discharged into a waterway. This requirement protects waterways, and preserves their environmental, recreational, and economic functions – including flood control, water filtration, and wildlife habitat.

The alleged violations occurred in May 2004 at a construction site for an industrial park. According to EPA, Dlesk Realty allowed the filling of about 890 linear feet of stream located near U.S. Route 88 (two miles west of Interstate-70, Elm Grove Interchange) in Wheeling.

In a consent agreement with EPA, Dlesk Realty agreed to pay a $5,000 penalty and will also apply for a permit with the Army Corps of Engineers. This “after the fact” permit will require mitigation of the adverse effect on waterways caused by the alleged violation.
