TWO CALIFORNIA MEN CHARGED WITH HAZARDOUS WASTE CRIMES

Marvin E. Hutchinson of Bonita, Calif., and Gary A. Rasmussen of San Diego, Calif., were indicted on April 28 in U.S. District Court for the Southern District of California in San Diego on charges that they violated the Hazardous Materials Transportation Act. The indictment alleges that on Feb. 28, Hutchinson and Rasmussen illegally transported hazardous wastes, including highly poisonous cyanide compounds, acids and potentially explosive crystalized picric acid and tetrahydrofuran, from a self-storage facility in Oceanside, Calif., to a vacant lot in Chula Vista, Calif. Hutchinson is also charged with illegally transporting hazardous waste from the facility in Oceanside to his home in Bonita on the same day. Cleanup of the lot in Chula Vista cost EPA’s Superfund Program $100,000. Both men face maximum sentences of more than 10 years in prison and/or maximum fines of more than $500,000 if convicted on all counts. The case was investigated by EPA’s Criminal Investigation Division, the FBI, the San Diego Department of Environmental Health Services, and is being prosecuted by the U.S. Department of Justice.
