ILLEGAL HAZARDOUS WASTE HAULING SCHEME NETS 15 MONTH PRISON SENTENCE
On July 1, Donald F. Hartung was sentenced to 15 months in prison, 36 months of supervised release and was ordered to pay $75,000 in restitution to the EPA Superfund for violations of the Resource Conservation and Recovery Act and violations of the Clean Water Act . Hartung was the owner of the now defunct Industrial Cleaning and Recyclers (ICR), a company that picked up for disposal drums of contaminated sludge and caustic effluent from machine shops and industrial engine rebuilding operations. A search of Hartung's residence and a temporary storage locker facility in Auburn, Wash., uncovered 195 drums each containing 55 gallons of waste. Also found hidden under a trampoline at Hartung's residence was a sewer bypass line used to pump waste directly into the city sewer system. In addition, Hartung also falsified hazardous waste manifests. The offenses took place between October 1993 and November 1995. The case was investigated by EPA's Criminal Investigation Division and Washington State authorities.
