EPA PROPOSES $137,500 PENALTY AGAINST DELAWARE BUILDER FOR UNLAWFUL STORMWATER RUNOFF

NEW CASTLE COUNTY, Del. - The U.S. Environmental Protection Agency today announced that it has cited Allied Properties, Inc., for allegedly discharging stormwater runoff without authorization.  EPA seeks a $137,500 penalty for this violation of the Clean Water Act, which occurred at the company’s 65-acre construction site on State Road 273, between Eagle Run Road and Brown Lane, New Castle County, Del.  

Stormwater runoff from construction sites often contains pollutants -- such as oil and grease, chemicals, nutrients, heavy metals, and oxygen-demanding compounds -- that are picked up as rainwater or snowmelt, flow across the disturbed soil, and are discharged into surface waters.  Clean Water Act regulations require companies to notify the state of construction activity involving more than five acres, and to use sedimentation controls to minimize this water pollution threat.  

According to EPA, Allied Properties violated these regulations and ignored repeated violation notices and stop-work orders from New Castle County inspectors and the Delaware Department of Natural Resources (DNREC).  DNREC worked closely with EPA in investigating this case.

Allied Properties has the right to a hearing to contest the alleged violations and proposed penalty.
