Mobil Home Park in Millsboro, Del. Settles Clean Water Act Violations

PHILADELPHIA – The operators of the Colonial Estates Mobile Home Park in Millsboro, Sussex County, Del., have settled Clean Water Act violations concerning the wastewater treatment plant that serves the mobile home park’s 165 residents, the U.S. Environmental Protection Agency announced today.

Community Management Inc. and its parent corporation LHI of Delaware agreed to pay a $22,325 penalty to settle violations of Colonial Estates’ Clean Water Act permit limiting pollution discharges to an unnamed tributary to the Indian River.

According to EPA’s administrative complaint, Colonial Estates exceeded permit limits on the discharge of total suspended solids, total coliform, and biochemical oxygen demand (depleting the water’s oxygen) from September 1996 to July 2001, and failed to submit timely discharge monitoring reports during this period.

As provided by the Clean Water Act, the Delaware Department of Natural Resources and Environmental Control (DNREC) establishes EPA-approved water quality standards to protect the state’s waterways, and issues permits to pollution sources setting discharge limits and monitoring requirements. DNREC worked with EPA in the investigation of this case.

As part of the settlement, Colonial Management Inc. and LHI neither admitted nor denied liability for the alleged violations. Colonial Estates ceased surface water discharges when it converted to using spray irrigation to dispose of its wastewater in December 2001.
