EPA SEEKS $30,000 PENALTY FOR CLEAN WATER ACT VIOLATIONS AT WASTEWATER PLANT IN MONACA BOROUGH

MONACA, Pa. - The U.S. Environmental Protection Agency today announced that it has cited Monaca Borough, Beaver Co., Pa. for Clean Water Act violations at its wastewater treatment plant.

In an administrative complaint, EPA seeks a $30,000 penalty for violations of  Monaca’s "pretreatment" duties under the Clean Water Act.  The law requires publicly-owned wastewater treatment plants to enforce permits limiting the pollutants that industrial users discharge to the plants.  These permit limits are designed to avoid overburdening the plant’s capacity.

In its complaint, EPA alleges that Monaca’s pretreatment program was deficient in several respects, including a failure to reevaluate its local limits; failure to include in its permits required enforcement and reporting mechanisms; failure to require its users to conform with compliance monitoring and reporting requirements; and failure to fully and effectively implement its enforcement response plan.  

The borough has the right to a hearing to contest the alleged violations and proposed penalty.
