Occidental Chemical Corp. to pay $66,750 for Alleged Hazardous Waste Violations at West Virginia Plant

BELLE, W.Va. -- Occidental Chemical Corp. will pay a $66,750 penalty for allegedly violating hazardous waste regulations at its chemical manufacturing facility in Belle, W.Va., the U.S. Environmental Protection Agency announced today.

In a September 1998 administrative complaint, EPA cited the company for several violations of the Resource Conservation and Recovery Act (RCRA), a federal law regulating the treatment, storage, and disposal of hazardous waste.

The alleged violations, documented in inspections by the West Virginia Division of Environmental Protection (WVDEP), included:

• storing carbon tetrachloride and chloroform sump waste on an outdoor concrete pad without a permit from October 24 to November 2, 1994,

• storing contaminated waste filters (methylene chloride, chloroform and carbon tetrachloride) in open containers at the time of WVDEP’s October 24 and November 2, 1994 inspections;

• failing to properly track manifests of five November 1994 hazardous waste shipments;

• storing containers of hazardous waste either without the words Ahazardous waste@ appearing on the containers or without accumulation dates appearing on the containers.

The company has neither admitted or denied liability for these violations in the settlement agreement, but it has certified that it is now in compliance with applicable RCRA regulations.
