IOWA COMPANY AND OWNER INDICTED
On Feb. 20, Fiberdyne Inc., of Cedar Falls, Iowa, and Mikkel Mandt, a director and owner of Fiberdyne, were indicted in U.S. District Court for the Northern District of Iowa in Cedar Rapids on charges that they violated the Resource Conservation and Recovery Act. Fiberdyne and Mandt were each charged with one count of illegally treating hazardous waste, one count of illegally disposing of hazardous waste and two counts of illegally transporting hazardous waste. Fiberdyne manufactures fiberglass water treatment systems and maintains facilities in Cedar Falls and New Hartford, Iowa. The indictment alleges that the defendants illegally disposed of spent acetone solvent by burning it and by dumping distillery equipment “bottoms” containing acetone residue into dumpsters that were taken to the Black Hawk County Landfill for disposal. In addition, the defendants are charged with transporting the spent acetone between their facilities without having a permit. If convicted, Fiberdyne could face a maximum sentence of up to 20 years probation, fines of up to $2 million or both. Mandt, if convicted, faces a maximum prison sentence of up to 20 years, fines up to $1 million or both. The case was investigated by EPA’s Criminal Investigation Division.
