NEW JERSEY EX-BUSINESSMAN INDICTED ON RCRA CHARGES
Elliot Packer, former owner and operator of Royal Recovery Systems Inc., in Plainfield, N.J., was indicted on Nov. 29 in U.S. District Court for the District of New Jersey in Newark for allegedly violating the Resource Conservation and Recovery Act. Royal Recovery was a precious metals recovery business. From approximately 1991 to at least 1995, the defendant allegedly stored at the Royal Recovery containers of chemicals containing hazardous waste including cyanide compounds without a permit. Contact with sufficient amounts of cyanide containing compounds can cause serious neurological injuries and even death. In 1995, a fire at the site prompted EPA to conduct a Superfund cleanup. If convicted of all charges, the defendant faces a sentence of up to five years in prison and/or a fine of up to $250,000. The case was investigated by EPA’s Criminal Investigation Division and the FBI with the support of the EPA Edison Regional Laboratory and EPA’s National Enforcement Investigations Center. The case is being prosecuted by the U.S. Attorney’s Office for the District of New Jersey.
