MISSOURI MAN PLEADS TO CLEAN WATER ACT CHARGES

Gary L. Smith, owner of Warren County Water and Sewer District in Warren County, Mo., pleaded guilty on Aug. 16 to charges that he violated the Clean Water Act. Smith intentionally allowed raw sewage to be discharged into Incline Village Lake, a recreational-use lake. Raw sewage can contain bacteria and pathogenic organisms which can cause infections and its discharge into recreational waters can make them unsafe for swimming and other recreational activities. When sentenced, Smith faces a maximum sentence of up to three years in prison and/or up to $250,000 in fines. The case was investigated by EPA’s Criminal Investigation Division and the EPA National Enforcement Investigations Center and is being prosecuted by the U.S. Attorney’s Office in St. Louis, Mo.
