EPA ANNOUNCES $1 MILLION SUPERFUND RECOVERY COST
On May 15, an Agreement for Recovery of Past Costs became effective with 623 parties that contributed hazardous substances to the XXKEM Co. facility in Toledo, Ohio. EPA expects to receive approximately $1.06 million in settlement payments based on each settlor's share of waste. This cost recovery represents 78 percent of EPA's costs incurred at the site. Both large and small waste volume contributors received the settlement offer. The XXKEM Site was operated by XXKEM Co. as a fuel blender and broker beginning in March 1989 through 1991. The agreement settlors were former customers of XXKEM Co. and mainly auto dealerships and repair shops. The Ohio EPA notified EPA in June 1992 concerning the potential hazards posed by wastes at the site. EPA stabilized the site by removing hazardous substances and waste drums from the site surface from January to May 1993. Some soil contamination remains at the site, and EPA is still reviewing the need for further site remediation. In April 1993, the XXKEM Company's owner, Kenneth Barzacchini, was convicted of violating several Ohio laws (including environmental laws), fined and sentenced to a prison term as a result of a lawsuit brought by the Ohio Attorney General's Office.
