WEST VIRGINIA COMPANY FINED IN CHILD INJURY CASE

IMC Corp., which formerly manufactured sewing machine cabinets near Sutton, W.Va., was fined $10,000 and was placed on one year’s probation on May 28, in U.S. Court for the Northern District of West Virginia in Clarksburg. In addition, IMC must sponsor a free seminar for small quantity generators on compliance with hazardous waste regulations. The company previously pleaded guilty to releasing approximately 400 gallons of a highly acidic water/chemical boiler cleaning mixture in August 1992. The hazardous mixture was released into a ditch that lead into the Elk River, and a young boy and his dog were burned when they came into contact with it. The case was investigated by EPA’s Criminal Investigation Division, the FBI, the West Virginia Department of Natural Resources and the West Virginia Division of Environmental Protection.
