Powerex, Inc. Settles Hazardous Waste Violations

PHILADELPHIA – Powerex, Inc. has agreed to pay a $30,000 penalty to settle alleged violations of hazardous waste regulations at the company’s plant in Youngwood, Pa., the U.S. Environmental Protection Agency announced today.
EPA cited the company for violating the Resource Conservation and Recovery Act (RCRA), the federal law governing the treatment, storage, and disposal of hazardous waste. The law is designed to protect public health and the environment, and avoid costly cleanups, by requiring the safe, environmentally sound storage and disposal of hazardous waste.
The Powerex facility, which manufactures semi-conductors, has a 1000 gallon above-ground tank used to store hazardous waste solvents. Based on a December 2004 inspection by EPA and the Pennsylvania Department of Environmental Protection, EPA cited the company for failing to comply with various RCRA regulations related to this tank, including equipment safeguards, air emission controls, and hazardous waste labeling requirements. EPA also alleged that the company failed to conduct required annual hazardous waste training for its employees in 2001-2004.
The settlement penalty reflects the company’s cooperation with EPA in the investigation and resolution of the alleged violations. As part of the settlement, the company has neither admitted nor denied liability for the alleged violations, but has certified its compliance with applicable RCRA requirements.
