DATABASE PUBLICLY AVAILABLE ON THE INTERNET
DATABASE PUBLICLY AVAILABLE ON THE INTERNET
EPA’s Office of Enforcement and Compliance Assurance has released an Internet-based Supplemental Environmental Projects (SEP) National Database. SEPs are environmentally beneficial projects that a defendant in an environmental enforcement action agrees to undertake as part of a settlement, but which the defendant is not otherwise legally required to perform. In return, some percentage of the cost of the SEP is considered as a factor in establishing the penalty paid by the defendant. These SEP projects can result in improvements to the environment that might not occur. The SEP National Database currently contains 318 projects included in enforcement settlements for Fiscal Years 1994-1996. The database contains the following information: the statutory violation; a description and technical details of the SEP; its estimated cost of implementation; and the expected environmental impacts of the projects. The homepage also contains SEP-related policy and guidance documents and sample settlement language. Additional SEPs will be added to the database as information on new settlements becomes available.
