NEW RULE PROVIDES RELIEF FOR RETAIL GAS STATIONS
A final rule issued by the EPA provides relief from reporting requirements for retail gas stations with tanks holding less than 75,000 gallons of gasoline or 100,000 gallons that are in compliance with all underground storage tank requirements. Facilities meeting these criteria do not have to file gas and diesel inventory reports for calendar year 1998, which are due March 1, 1999. The EPA eliminated reporting on gasoline and diesel inventories for these facilities because the public and local emergency planners and responders are aware of their presence and the hazards posed. Also, these retail gas stations already report similar information to state offices under the underground storage tank regulations. Retail gas stations may still be required to report chemical inventory information if required by the state or if information is requested by the local
firefighters, Local Emergency Planning Committees or State Emergency Response Commissions. Emergency Planning and Community Right to Know Act sections 311 and 312 requires facilities to provide state and local officials with an annual hazardous chemical inventories to support public awareness of chemical hazards and local emergency planning.
