Construction Firm and Resident Ordered to Clean Up Polluted Creek

Denver -- The U.S. Environmental Protection Agency (EPA) today ordered Temple Construction, Inc. and a property owner to remove excavated soil they dumped into Farnsworth Creek and adjacent wetlands at a proposed residential site near Steamboat Springs, CO.

Until removal, the soil -- excavated to build a recreational pond and roads -- continues to threaten water quality in the creek and wetlands health. In addition, the recreational pond may impact several federally listed endangered species. Property owner Cristy Coleman and Temple Construction were ordered to develop a plan for removing the unauthorized material and restoring the wetlands. All restoration plans must be prepared by a qualified wetlands scientist and approved by EPA.

By law, Temple Construction and Ms. Coleman must have permits, including proposed mitigation for all impacts, for any activities associated with the proposed development which will impact our nation's waters. EPA has long-term concerns about the full impact of the proposed development activities on Farnsworth Creek and its adjacent wetlands and tributaries. The development is expected to include a private residence, barn complex, guest house, recreation pond and associated roads. In violating the Clean Water Act, they face possible civil penalties of up to $27,500 per day for each day the fill remains in place.

"EPA is taking this action to protect water quality in Farnsworth Creek and its adjacent wetlands by removing excavated soil dumped there during construction of a recreational pond and roads," EPA Enforcement Administrator Carol Rushin said.

Property owners or contractors planning to do any stream alterations should always contact their U.S. Corps of Engineers' regulatory office and inquire about permit requirements prior to starting work.
