SETTING EMERGENCY USE PESTICIDE TOLERANCES

As required by the Food Quality Protection Act (FQPA), EPA is now establishing tolerances for pesticide uses granted under the emergency exemption provision of the Federal Insecticide, Fungicide and Rodenticide Act. This proposed rule solicits public comment on the procedures and criteria for EPA to establish pesticide tolerances (maximum residue limits) resulting from emergency uses of pesticides. Prior to passage of FQPA, EPA did conduct a health and safety review on the proposed use, but did not set tolerances for emergency uses. EPA is now required to establish time-limited tolerances that meet the new FQPA safety requirements. Specifically, in reviewing applications for emergency use pesticides, the Agency will establish time-limited tolerances after evaluating all potential exposures to the pesticide, including through the diet, drinking water, and other non-occupational exposures, as well as ensuring the tolerance will be protective of infants and children. Under EPA’s proposal, the criteria for defining when an emergency situation exists has not changed. Generally, the Agency recognizes an emergency situation when a pesticide or another agricultural tool is not available for a specific crop, and a significant economic loss is expected as a result. Written comments on the proposal will be accepted on or before August 2.
