EPA today issued a proposal for identifying when conventional and chemical military munitions become a hazardous waste under the Resource Conservation and Recovery Act (RCRA). The Federal Facility Compliance Act of 1992 requires EPA, in consultation with the Department of Defense (DOD) and the states, to provide for protective storage and transportation of these wastes. Military munitions used for their intended purpose, such as training activities or in activities associated with training such as range clearance, are not regulated under RCRA.

EPA is proposing to regulate military munitions under RCRA when removed from storage in the stockpile for the purpose of disposal or for treatment prior to disposal; leaking or deteriorated to the point that the material cannot be recycled; or when DOD declares them to be a solid waste.

Immediate responses, such as emergencies involving explosives, taken by trained personnel including military, governmental or private, would not be subject to RCRA permitting requirements.
