RULE PROPOSED FOR STORAGE, TREATMENT,
TRANSPORTATION AND DISPOSAL OF MIXED WASTE
EPA is proposing changes to its regulations under Subtitle C of the Resource Conservation and Recovery Act (RCRA) to provide a conditional exemption from the definition of "hazardous" for low-level mixed waste for storage and for low-level radioactive waste or naturally occurring and/or accelerator-produced radioactive material that is mixed with hazardous waste for transportation and disposal. This proposal will enable generators of this waste who are licensed by the Nuclear Regulatory Commission (NRC) to store and treat low-level mixed waste in tanks or containers (using solidification, neutralization or other stabilization processes) without a RCRA permit. This proposal will also provide flexibility for the manifesting, transportation and disposal of eligible waste. Waste meeting the proposed conditions will be exempted from certain RCRA Subtitle C hazardous waste requirements and then could be managed as a radioactive waste in accordance with NRC regulations.
