History – IUR Requirements Changed Substantially beginning with the 2006 Reporting
In January 2003 and December 2005, EPA finalized substantial changes to the IUR requirements that were implemented beginning with 2006 reporting. These changes tailored the chemical substance reporting requirements to more closely match EPA's information needs; to obtain new and updated information concerning processing and use of a subset of chemical substances listed in the TSCA Inventory; and to improve the utility of the information reported.
The major modifications included:
- Changes that impacted the need to report:
- Reporting for inorganic chemicals (in addition to organic chemicals) was added and the requirement to report certain forms of natural gas was removed.
- The production volume threshold that triggers reporting was raised from 10,000 pounds to 25,000 pounds.
- The period for which reporting is required was changed from a corporate fiscal year basis to a calendar year basis.
- Additional required information about manufacturing:
- Number of workers reasonably likely to be exposed to the chemical substance at the site of manufacture or import;
- Physical form(s) of the substance as it leaves the submitter's possession;
- Percentage of the total production volume associated with each physical form; and
- Maximum concentration of the chemical substance at the time it is reacted onsite to produce a different chemical substance or as it leaves the site where it is manufactured or imported.
- Addition of processing and use information for chemicals produced in amounts equal to or greater than 300,000 pounds. For 2006 reporting, the processing and use information was not required for inorganic chemicals. Also, certain listed chemicals are partially exempted from IUR and the processing and use information is not required. New data elements included:
- Type of processing or use operation;
- NAICS codes that best describe the industrial activities associated with the processing or use;
- Industrial functions of the chemical substance during the processing or use operation;
- Percent production volume, number of sites, and number of workers associated with each processing or use/NAICS/industrial function combination;
- Commercial and consumer uses;
- Indication of the presence of the substance in consumer products intended for use by children;
- Percent of production volume associated with each commercial or consumer use; and
- Maximum concentration associated with each commercial or consumer use.
