State and Tribal Assumption of Section 404 of the Clean Water Act
This site is designed to increase state and Tribal program managers' understanding of the procedures and requirements for assumption of the Clean Water Act (CWA) Section 404 permitting responsibility, as well as answer questions about implementation of approved state and Tribal Section 404 programs.

On August 14, 2023 the U.S. Environmental Protection Agency (EPA) published a proposed rule that would streamline and clarify the requirements and steps necessary for states and Tribes to administer programs protecting waterways from discharges of dredged or fill material without a permit. The public comment period for this closed on October 13, 2023.
