EPA Secures Agreement from Chemours to Conduct New Sampling for PFAS Contamination near Washington Works, WV Facility
On December 20, 2023, Chemours Company FC, LLC agreed to conduct sampling for per- and polyfluoroalkyl substances, or PFAS, surrounding its Washington Works facility in Washington, West Virginia. The agreement under Section 3013 of the Resource Conservation and Recovery Act (RCRA) requires Chemours to take samples and analyze soil, surface water, sediment, groundwater, and certain waste streams generated by the facility to collect information on known and potential PFAS contamination. This agreement will provide data to improve the agency’s understanding of the extent of PFAS contamination and how migration of PFAS contamination may impact communities. Cleanup Status
In 2015, the West Virginia Department of Environmental Protection (WVDEP) issued a Final Decision Response to Comments (FDRTC or Final Decision) to address volatile organic compounds and perfluorooctanoic acid (PFOA). The Final Decision consists of monitored natural attenuation in conjunction with the continued control, capture, and treatment of contaminated groundwater and the implementation of Institutional Controls (ICs). WVDEP continues to monitor the cleanup progress at the facility.

Chemours/DuPont Washington Works is approximately 1,200 acres and is located along the Ohio River in Washington, West Virginia, approximately seven miles southwest of Parkersburg, WV. Manufacturing at the facility began in 1948; and beginning in 1951, per-and polyfluoroalkyl substances (PFAS) were manufactured, produced, generated, or used at the facility.

Institutional and Engineering Controls at this Facility
The ICs shall include, but not be limited to, the following land and groundwater use
restrictions:
- Except for the production water that is already approved for treatment and use as potable water at the Facility, groundwater at the Facility shall not be used for any purpose other than: 1) industrial use and non-contact cooling water; and 2 ) the operation, maintenance, and monitoring activities required by WVDEP and/or EPA, unless it is demonstrated to WVDEP, in consultation with EPA, that such use will not pose a threat to human health or the environment or adversely affect or interfere with the selected remedy and WVDEP, in consultation with EPA, provides prior written approval for such use;
- The Facility property shall not be used for residential purposes unless it is demonstrated to WVDEP, in consultation with EPA, that such use will not pose a threat to human health or the environment or adversely affect or interfere with the selected remedy, and WVDEP, in consultation with EPA, provides prior written approval for such use.
- All earth moving activities, including excavation, drilling and construction activities, in the areas at the Facility where any contaminants remain in soils above EPA's Screening levels for non-residential use or groundwater above Federal MCLs, tap Water RBCs, shall be prohibited unless it is demonstrated to WVDEP, in consultation with EPA, that such activity will not pose a threat to human health or the environment or adversely affect or interfere with the selected remedy, and WVDEP, in consultation with EPA, provides prior written approval for such use.
- The Property will not be used in a way that will adversely affect or interfere with the integrity and protectiveness of the final remedy.
- No new wells will be installed on Facility property unless it is demonstrated to WV DEP and EPA they are necessary to implement the final remedy and WV DEP provides prior written approval to install such wells.

Site Responsibility at this Facility
RCRA Corrective Action activities at this facility have been conducted under a permit issued by WVDEP with assistance from EPA Region 3. Activities conducted under the RCRA section 3013 Administrative Order on Consent are under the direction of EPA Regions 3, 5 and the Office of Enforcement and Compliance Assurance.
