Public Notice: Proposed CAFO CWA-05-2025-0002
Summary
The U.S. Environmental Protection Agency (EPA), Region 5, is providing this notice of its intent to issue a Consent Agreement and Final Order (Proposed CAFO) against D.R. Horton – Indiana LLC (Respondent) for violations of Section 301 of the Clean Water Act (CWA). This Proposed CAFO will settle alleged violations at a site located in Marion County, Indiana. The Respondent discharged dredged and fill material into tributaries and wetlands abutting tributaries to Quack Branch without a CWA permit.
EPA alleges that between July 2022 and December 2022, Respondent, or its contractors, used bulldozers, track hoes, and other equipment to discharge dredged or fill material into approximately .52 acres of wetlands, of which .24 were impacted by draining, and 550 linear feet of tributaries associated with the Quack Branch.
The alleged violations are of environmental significance because the wetlands and streams reduced siltation and sedimentation into Quack Branch, provided habitat for wildlife, improved surface water filtration of pollutants, and provided flood attenuation functions to the watershed and downstream waters.
EPA and Respondent have agreed in principle that the Respondent will pay a civil penalty of $105,702 to resolve these violations.
