Public Notice: Clean Water Act Certification for the Canyon Wastewater Treatment Plant Project in Yellowstone National Park
Summary
The U.S. Environmental Protection Agency (EPA) received a request from the National Park Service, Yellowstone National Park for a Clean Water Act (CWA) Section 401 water quality certification (WQC) for the above project. Section 401(a)(1) of the CWA requires applicants for Federal permits and licenses that may result in any discharge into waters of the United States to obtain certification or waiver from the certifying authority where the discharge would originate.
The EPA acts as the certifying authority on lands of exclusive federal jurisdiction in relevant respects, in this case on lands within Yellowstone National Park. The EPA will act on this certification request by either: (1) granting certification; (2) granting certification with conditions; (3) denying certification; or (4) expressly waiving certification consistent with CWA Section 401 and the EPA’s implementing regulations at 40 CFR 121.
The proposed project would be covered under USACE CWA Section 404 Nationwide Permits (NWP) 58 and 39. NWP 58 authorizes utility line activities for water and other substances and addresses impacts to waters of the U.S. from pipeline activities that are not related to oil, natural gas, or petrochemicals. NWP 39 authorizes the construction or expansion of commercial and institutional building foundations and building pads and attendant features that are necessary for the use and maintenance of the structures.

The proposed project is to rehabilitate and replace components of the Canyon Village Wastewater Treatment Plant (WWTP) and upgrade segments of the collection system to improve wastewater treatment and collection. The project includes construction at six sites as described below.
Work completed below the ordinary highwater mark for the following three sites include:
- Demolition of existing buildings and lagoons at the Canyon Village WWTP and construction of new buildings and ponds within the existing fence limits. The Headworks Building will extend slightly beyond the existing fence to maintain operation during construction. Construction will result in permanent (0.069 acres) and temporary (0.079 acres) wetland impacts.
- Construction at the influent gravity sewer alignment to Canyon Village WWTP includes removal of existing 2,100 feet of 10 inch sewer pipe and replacement with a 12 inch sewer pipe using an open cut method along the existing alignment. Construction will result on 0.007 acres of temporary wetland impacts from excavation and 68 cubic yards of backfill.
- Construction at the Government Area gravity sewer alignment to Government Lift Station includes removal of 1,785 feet of 6 inch gravity sewer pipe that will be replaced with 8 inch gravity sewer pipe using an open cut method along the existing alignment. Construction will result in temporary wetland impacts from excavation and 77 cubic yards of backfill.
Upland work completed for the project includes demolition of the existing lift station building at the Government Area lift station and construction of a new building and overflow tank for the lift station pumps and valves. Work completed at the Government Area force main alignment includes abandoning the existing pumped pipeline from the lift station and constructing a new force main using an open cut method along a new alignment to avoid impacts to a wetland and trees that have grown in along the existing alignment. The new alignment will primarily be along an existing road and will cross two roads using a horizontal direction drill method. The existing lift station building at the Brink of Upper Falls will be demolished and a new building and overflow tank will be constructed for the lift station pumps and valves. There are no wetland impacts at these three upland sites.
