The safe drinking water act mandates that each state must have a UIC program. Many States have been given primary enforcement responsibility (primacy) for their UIC programs. Mid-Atlantic states with primacy:
- Delaware Department of Natural Resources and Environmental Control
- Maryland Department of the Environment
- West Virginia Department of Environmental Protection
If a state does not adopt primacy of the UIC program, EPA must implement the program for the state. EPA directly implements UIC programs in:
- District of Columbia
- Pennsylvania
- Virginia
