EPA and Army Finalize Rule Establishing Definition of WOTUS and Restoring Fundamental Water Protections
The U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (the agencies) announced a final rule establishing a durable definition of “waters of the United States” (WOTUS) to reduce uncertainty from changing regulatory definitions, protect people’s health, and support economic opportunity. The final rule restores essential water protections that were in place prior to 2015 under the Clean Water Act for traditional navigable waters, the territorial seas, interstate waters, as well as upstream water resources that significantly affect those waters. As a result, this action will strengthen fundamental protections for waters that are sources of drinking water while supporting agriculture, local economies, and downstream communities.

- Pesticide Registration Review; Proposed Interim Decision for Carbaryl; Notice of Availability
This notice announces the availability of EPA’s proposed interim registration review decision and opens a 75-day public comment period on the proposed interim decision for carbaryl. (December 1) - Notification of Submission to the Secretary of Agriculture; Pesticides; Agricultural Worker Protection Standard; Reconsideration of the Application Exclusion Zone Amendments
This document notifies the public as required by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) that the EPA Administrator has forwarded to the Secretary of the United States Department of Agriculture (USDA) a draft proposed rulemaking document concerning ‘‘Pesticides; Agricultural Worker Protection Standard; Reconsideration of the Application Exclusion Zone Amendments (RIN 2070–AK92).’’ The draft regulatory document is not available to the public until after it has been signed and made available by EPA. (December 2) - Pesticide Emergency Exemptions; Agency Decisions and State and Federal Agency Crisis Declarations
EPA has granted emergency exemptions under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) for use of pesticides as listed in this notice. The exemptions were granted during the period July 1, 2022, to September 30, 2022, to control unforeseen pest outbreaks. (December 2) - Valley Agronomics pays $144,400 EPA penalty for unsafe storage of pesticides
The U.S. Environmental Protection Agency announced today that Valley Agronomics, LLC of Greenleaf, Idaho agreed to pay a $144,400 penalty for violations of the Federal Insecticide, Fungicide, and Rodenticide Act. During a September 2019 inspection, the Idaho State Department of Agriculture found the company had violated important pesticides storage requirements meant to prevent accidental releases. (December 6) - Chlorpyrifos; Notice of Receipt of Requests To Voluntarily Cancel Certain Pesticide Registrations and Amend Registrations To Terminate/ Amend Certain Uses
In accordance with the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), EPA is issuing a notice of receipt of requests by the registrants to voluntarily cancel certain product registrations containing the pesticide chlorpyrifos and to amend their chlorpyrifos registrations to terminate one or more uses. EPA intends to grant these requests at the close of the comment period for this announcement, unless the Agency receives substantive comments within the comment period that would merit its further review, or the registrants withdraw their requests. If these requests are granted, any sale, distribution, or use of products listed in this notice will be permitted after the registrations have been cancelled or the uses terminated only if such sale, distribution, or use is consistent with the terms as described in the final order. (December 13) - Chlorpyrifos; Notice of Intent To Cancel Pesticide Registrations
Pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Environmental Protection Agency (EPA) hereby announces its intent to cancel the registrations of three pesticide products containing the insecticide chlorpyrifos due to the Agency’s revocation of all tolerances for chlorpyrifos. This document identifies the products at issue, summarizes EPA’s basis for this Notice of Intent to Cancel (NOIC), and explains how adversely affected persons may request a hearing and the consequences of requesting or failing to request such a hearing. (December 14) - Pesticides; Removal of PFAS Chemicals From Approved Inert Ingredient List for Pesticide Products
The Environmental Protection Agency (EPA) is removing twelve chemicals from the current list of inert ingredients approved for use in pesticide products because these inert ingredients have been identified as per-and polyfluoroalkyl substances (PFAS) and they are no longer used in any registered pesticide product. (December 14) - Propyzamide; Extension of Tolerance for Emergency Exemption
This regulation extends a time-limited tolerance for residues of the herbicide propyzamide in or on cranberry at 1 part per million (ppm) for an additional 3-year period. This tolerance will expire and is revoked on December 31, 2025. This action is in response to EPA’s granting of an emergency exemption under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) authorizing use of the pesticide on cranberry. In addition, the Federal Food, Drug, and Cosmetic Act (FFDCA) requires EPA to establish a time-limited tolerance or exemption from the requirement for a tolerance for pesticide chemical residues in food that will result from the use of a pesticide under an emergency exemption granted by EPA under FIFRA. (December 16) - Tetraniliprole; Pesticide Tolerances
This regulation establishes tolerances for residues of tetraniliprole in or on the grain, cereal, group 15, except rice; and grain, cereal, forage, fodder and straw, group 16, except field corn, popcorn, and sweet corn. Bayer CropScience requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). (December 16) - Iron Oxide (Fe3O4) in Pesticide Formulations Applied to Animals; Tolerance Exemption
This regulation establishes an exemption from the requirement of a tolerance for residues of iron oxide (Fe3O4) (CAS Reg. No. 1317–61–9) when used as an inert ingredient (colorant) in pesticide formulations applied to animals. The United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service submitted a petition (IN–11661) to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of iron oxide (Fe3O4), when used in accordance with the terms of that exemption. (December 22) - Simazine; Pesticide Tolerances
This regulation establishes tolerances for residues of simazine in or on citrus fruits (crop group 10–10), pome fruits (crop group 11–10), stone fruits (crop group 12–12), and tree nuts (crop group 14–12) and amends the tolerance for residues in or on almond hulls. Syngenta Crop Protection, LLC requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). (December 22) - Pesticide Registration Review; Proposed Interim Decisions for Several Pesticides; Notice of Availability
This notice announces the availability of EPA’s proposed interim registration review decisions and opens a 75-day public comment period on the proposed interim decisions for the following pesticides: 1,3- Propanediamine, N-(3-aminopropyl)-Ndodecyl-(1,3–PAD); DCNA; Etofenprox; Lavandulyl Senecioate; Norflurazon; Oregano Oil; Penta-termanone; Plant Extract 620; and Thiophanate-methyl and Carbendazim. EPA Announces Selection of Members to Farm, Ranch, and Rural Communities Federal Advisory Committee
U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced the appointment of 20 members, including the new Committee Chair and Committee Vice-Chair to the Farm, Ranch, and Rural Communities Federal Advisory Committee (FRRCC), which provides independent policy advice, information, and recommendations to the EPA Administrator on a range of environmental issues that are of importance to agriculture and rural communities.

EPA awards $7.7 Million for Research Grants to Improve Risk Assessment of Chemical Mixtures in the Environment
Today, the U.S. Environmental Protection Agency (EPA) announced $7,770,044 in research grant funding to 11 institutions to develop and evaluate innovative methods and approaches to inform our understanding of the human health risks that may result from exposure to chemical mixtures in the environment.

- 1,3-Benzenedicarboxylic Acid, 5-Sulfo-, Sodium Salt (1:1), Polymer With 1,3- Benzenedicarboxylic Acid, 1,4- Cyclohexanedimethanol and 2,2′- Oxybis[ethanol]; Tolerance Exemption
This regulation establishes an exemption from the requirement of a tolerance for residues of 1,3- benzenedicarboxylic acid, 5-sulfo-, sodium salt (1:1), polymer with 1,3- benzenedicarboxylic acid, 1,4- cyclohexanedimethanol and 2,2′- oxybis[ethanol] (CAS Reg. No. 54590– 72–6), when used as an inert ingredient in a pesticide chemical formulation. SciReg, Inc., on behalf of Eastman Chemical Company, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 1,3-benzenedicarboxylic acid, 5-sulfo-, sodium salt (1:1), polymer with 1,3-benzenedicarboxylic acid, 1,4- cyclohexanedimethanol and 2,2′- oxybis[ethanol], on food or feed commodities. (November 4) - Pesticides; Addition of Chitosan (Including Chitosan Salts) to the List of Active Ingredients Permitted in Exempted Minimum Risk Pesticide Products
The Environmental Protection Agency (EPA) is adding a substance commonly referred to as chitosan (also known by its chemical name: poly-Dglucosamine) (CAS No. 9012–76–4) to the list of active ingredients eligible for use in minimum risk pesticide products exempt from registration and other requirements of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). In doing so, EPA is specifying that the listing also includes those chitosan salts that can be formed when chitosan is mixed with the acids that are listed as active or inert ingredients eligible for use in minimum risk pesticide products. (November 8) - Acetic Acid, 2-Ethylhexyl Ester; Exemption From the Requirement of a Tolerance
This regulation establishes an exemption from the requirement of a tolerance for residues of acetic acid, 2- ethylhexyl ester (CAS Reg. No. 103–09– 3) when used as an inert ingredient (solvent/cosolvent) at a concentration not to exceed 50% in pesticide formulations applied to growing crops. SciReg, Inc., on behalf of Solvay USA Inc., submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of acetic acid, 2-ethylhexyl ester, when used in accordance with the terms of the exemption. (November 8) - Nitric Acid; Exemption From the Requirement of a Tolerance
This regulation establishes an exemption from the requirement of a tolerance for residues of nitric acid (CAS Reg. No. 7697–37–2) when used as an inert ingredient (pH adjuster) applied to crops and raw agricultural commodities pre- and post-harvest, limited to no more than 10% by weight in the pesticide formulation. Technology Sciences Group, Inc. on behalf of Organisan Corporation, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of nitric acid when used in accordance with the terms of the exemption. (November 8) - Sulfur Dioxide; Pesticide Tolerances
This regulation establishes a tolerance for residues of sulfur dioxide in or on blueberry. Interregional Research Project Number 4 (IR–4) requested this tolerance under the Federal Food, Drug, and Cosmetic Act (FFDCA). EPA has received applications to register new uses for pesticide products containing currently registered active ingredients. Pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA is hereby providing notice of receipt and opportunity to comment on these applications. This notice announces EPA’s order for the cancellations and amendments to terminate uses, voluntarily requested by the registrants and accepted by the Agency, of certain product registrations, pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This cancellation order follows an August 29, 2022, Federal Register Notice of Receipt of Requests from the registrants listed in Table 3 of Unit II, to voluntarily cancel and amend certain product registrations to terminate uses of these product registrations. In the August 29, 2022, notice, EPA indicated that it would issue an order implementing the cancellations and amendments to terminate uses, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests. The Agency did not receive any comments on the notice. Further, the registrants did not withdraw their requests. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested cancellations and amendments to terminate uses. Any distribution, sale, or use of the products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions. (November 22) - 2,6-Pyridinedicarboxylic Acid; Exemption From the Requirement of a Tolerance
This regulation establishes exemptions from the requirement of a tolerance for residues of 2,6- pyridinedicarboxylic acid, also known as DPA (CAS Reg. No. 499–83–2), when used as an inert ingredient in antimicrobial pesticide formulations for use on food contact surfaces in public eating places, dairy processing equipment, and food processing equipment and utensils and when used in pesticide formulations applied preand post-harvest to crops with an enduse concentration not to exceed 2 parts per million (ppm). EcoLab Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting the establishment of such exemptions from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of DPA. (November 23) - Notice of Approval Status; Certifying Authorities’ Amended Plans for Certification of Commercial and Private Applicators of Restricted Use Pesticides; Batch One
The Environmental Protection Agency (EPA) is announcing its approval of thirteen amended certification plans for certifying applicators of Restricted Use Pesticides (RUPs) from the following certifying authorities: Alaska Department of Environmental Conservation (ADEC); California Department of Pesticide Regulation (DPR); Nebraska Department of Agriculture (NDA); New York Department of Environmental Conservation (NYSDEC); Oregon Department of Agriculture (ODA); Puerto Rico Department of Agriculture (PRDA); U.S. Department of Agriculture, Animal and Plant Health Inspection Service, Plant, Protection and Quarantine (USDA APHIS PPQ); U.S. Department of Agriculture, Forest Service (USDA FS); U.S. Department of Defense (DoD); U.S. Department of Energy (DoE); U.S. Department of the Interior, Bureau of Land Management (DOI BLM); Vermont Agency of Agriculture, Food and Markets (VAAFM); and Virgin Islands Department of Planning and Natural Resources (VIDPNR). The amended plans are consistent with the existing regulatory requirements, including revisions made in 2017 to enhance and improve the competency of certified applicators of RUPs and persons working under their direct supervision. The 2017 regulatory revisions are intended to further reduce potential exposure of RUPs to certified applicators and those working under their direct supervision, other workers, the public, and the environment. Federal, state, territory, and tribal certifying authorities with existing certification plans are required to revise their existing plans to conform with the updated federal standards for RUP applicator certification. The Environmental Protection Agency (EPA) has submitted an information collection request (ICR), Producers, of Pesticides and Pesticide Devices under Section 8 of The Federal Insecticide, Fungicide, and Rodenticide Act (EPA ICR Number 0143.14, OMB Control Number 2070–0028) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act. This is a proposed extension of the ICR, which is currently approved through November 30, 2022. Public comments were previously requested via the Federal Register on September 7, 2022, during a 60-day comment period. This notice allows for an additional 30 days for public comments. A fuller description of the ICR is given below, including its estimated burden and cost to the public. Spring Trading Company, on behalf of Clariant Corporation, submitted a petition (IN– 11126) to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of N,Ndimethylnonanamide, when used in accordance with the terms of these exemptions. (November 30)

EPA awards $195,000 to Ohio University for project to reuse waste from food and brewery sectors
Today, U.S. Environmental Protection Agency announced a $195,736 grant to Ohio University in Athens to fund a project that expands the use of anaerobic digesters to divert food waste from landfills and reduce methane emissions. Ohio University’s Voinovich School of Leadership and Public Service will use the funding to promote anaerobic digestion in the food and brewery sectors which generate large quantities of organic waste.

EPA awards Food Lifeline $200,000 for project to reduce methane, food waste in South Seattle
The U.S. Environmental Protection Agency has awarded Food Lifeline of Seattle approximately $200,000 to assist in the development of a community-owned anaerobic digester in the South Park neighborhood of Seattle.

EPA Launches Updates to Environmental Justice Mapping Tool EJScreen
The U.S. Environmental Protection Agency (EPA) has updated and added new capabilities to EJScreen, the Agency's public environmental justice (EJ) screening and mapping tool. EJScreen combines environmental and socioeconomic information to identify areas overburdened by pollution. EJScreen 2.1 includes the addition of new data on US territories, threshold maps which provides a cumulative outlook, and supplemental indexes providing additional socioeconomic information.

EPA Celebrates Children’s Health Month, Announces Grant to Study Farm Worker Family Health in El Paso
The U.S. Environmental Protection Agency (EPA) announced a grant to the Texas Tech University Health Sciences Center at El Paso to assess the impacts of pesticide use and its health effects on migrant farmworkers and their children along the US/Mexico Border. The study is part of the collaboration between EPA and the Southwest Center for Pediatric Environmental Health Specialty Unit (PEHSU). The announcement kicks off Children’s Health Month, recognized each October.

EPA Launches New Online Tools to Provide Communities with Information on Environmental Enforcement and Compliance
The US Environmental Protection Agency (EPA) announced two new online tools available to the public that provide additional information on environmental enforcement and compliance in their communities. Through improved transparency, advanced technologies and community participation, these tools empower the public to help EPA assure compliance nationwide and protect public health and the environment.

Biden-Harris Administration and EPA Announce Delivery of Historic Water Infrastructure Funding from the Bipartisan Infrastructure Law to 18 States
The U.S. Environmental Protection Agency (EPA) awarded Bipartisan Infrastructure Law funding to the first 18 states across the country for water infrastructure improvements. President Biden’s Bipartisan Infrastructure Law allocates more than $50 billion to EPA toward repairing the nation’s essential water infrastructure, which helps communities access clean, safe and reliable drinking water, increase resilience, collect and treat wastewater to protect public health, clean up pollution, and safeguard vital waterways. More than $1.1 billion in capitalization grants from the Bipartisan Infrastructure Law have been issued to 18 states through the State Revolving Funds (SRFs), with additional capitalization grants forthcoming. The grants mark the first significant distribution of water infrastructure funds thanks to the Bipartisan Infrastructure Law. State allocations were previously announced.

The Environmental Protection Agency (EPA) hereby announces its order for the cancellations, voluntarily requested by the registrants and accepted by the Agency, of the products listed in Table 1 and Table 1A of Unit II, pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This cancellation order follows an April 28, 2022, Federal Register Notice of Receipt of Requests from the registrants listed in Table 2 of Unit II, to voluntarily cancel these product registrations. In the April 28, 2022, notice, EPA indicated that it would issue an order implementing the cancellations, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests. The Agency received seven comments on the notice regarding the registrations containing the ingredient chlorpyrifos. The chlorpyrifos registrations are not included in this cancellation order and have been addressed in a separate order. Registrants did not withdraw their requests. Accordingly, EPA hereby issues in this cancellation order granting the requested cancellations shown in this cancellation order. Any distribution, sale, or use of the products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions. EPA Proposes Designating Certain PFAS Chemicals as Hazardous Substances Under Superfund to Protect People’s Health
Following through on the Biden-Harris Administration’s commitment to tackle environmental injustice and improve public health, the U.S. Environmental Protection Agency (EPA) is taking a significant action under Administrator Regan’s PFAS Strategic Roadmap to protect people and communities from the health risks posed by certain PFAS, also known as “forever chemicals.” EPA is proposing to designate two of the most widely used per- and polyfluoroalkyl substances (PFAS) as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as “Superfund.” This rulemaking would increase transparency around releases of these harmful chemicals and help to hold polluters accountable for cleaning up their contamination.

Biden-Harris Administration Launches EPA-USDA Partnership to Provide Wastewater Sanitation to Underserved Rural Communities
At an event in Lowndes County, Alabama, where a significant number of residents lack access to wastewater infrastructure, the U.S. Environmental Protection Agency (EPA) and U.S. Department of Agriculture (USDA) announced the Closing America’s Wastewater Access Gap Community Initiative. The new initiative will be piloted in 11 communities across the country where residents lack basic wastewater management that is essential to protecting their health and the environment. EPA, USDA, the states of Alabama, Kentucky, Mississippi, New Mexico, North Carolina, and West Virginia, and Tribes will jointly leverage technical assistance resources to help historically underserved communities identify and pursue federal funding opportunities – including from President Biden’s Bipartisan Infrastructure Law – to address their wastewater needs and eliminate harmful exposure to backyard sewage.

EPA awards $200,000 to San Luis Valley Local Foods Coalition for food waste project
The U.S. Environmental Protection Agency (EPA) has awarded $200,000 to the San Luis Valley Local Foods Coalition for a food waste processing project that will help divert food and other organic waste from landfills. The Valley Roots Food Hub (VRFH), a program of the San Luis Valley Local Foods Coalition, plans to install a high-efficiency anaerobic digestion (AD) system at its Mosca, Colorado campus to process food and organic waste and turn it into fuel.

EPA Marks National Pollinator Week by Launching Pilot Projects and Resources Portal to Help Protect Vulnerable Species from Pesticides
U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan issued a proclamation marking National Pollinator Week. This year’s proclamation highlights EPA’s commitment to protecting federally listed endangered and threatened (listed) pollinators from effects of pesticides by kicking off two new pilot projects. As outlined in EPA’s Endangered Species Act (ESA) Workplan, these pilot projects include input and collaboration between EPA, federal partners, and other stakeholders to develop protections for a subset of endangered species from specific pesticides. EPA also continues to advance pollinator outreach efforts through a new webpage that provides resources to learn about pollinator protection activities.

EPA Awards $152,000 to DC Department of Public Works for Training and Certification to Divert Food Waste
The U.S. Environmental Protection Agency is announcing the selection of the D.C. Department of Public Works (DC DPW) to receive a grant of $152,000 to establish an innovative training and certification program for commercial food waste generators in Washington, D.C. The program, known as “Food Waste Ready,” will prepare and certify commercial food waste generators, like restaurants, to set-up successful programs to separate organics and divert food waste to anaerobic digesters for processing.

EPA Announces $60 Million from Bipartisan Infrastructure Law for Nutrient Pollution Reduction in the Mississippi River/Gulf of Mexico Watershed
U.S. Environmental Protection Agency (EPA) Assistant Administrator for Water Radhika Fox, joined by Iowa Secretary of Agriculture Mike Naig, announced $60 million over the next five years to fund nutrient reduction efforts through the Gulf Hypoxia Program. Hypoxia means low oxygen levels in water and can be caused by excess nutrients such as nitrogen and phosphorus. Hypoxia can impact ecosystems, killing fish and other wildlife, creating aquatic dead zones in severe areas.

EPA New England Announces the University of Vermont is Receiving a Grant to Help Tackle the Climate Crisis Through Food Waste Diversion
The U.S. Environmental Protection Agency (EPA) awarded the University of Vermont approximately $200,000 in funding to perform a study to assess current capacity at on farm digesters to accept food wastes; the potential impacts of food waste co-digestion on biogas production; and the potential impacts of co-digestion on nutrients and microplastics in digestate. The goal of this grant opportunity nationally is to help reduce food loss and waste and to divert food waste from landfills and incinerators by expanding anaerobic digester capacity in the United States. The grant is one of 11 projects selected for funding in 2022 which include feasibility studies, modeling efforts, demonstration projects, as well as technical assistance and training.

EPA and Army Host Midwest-Focused Virtual Regional WOTUS Roundtable

Spring Regulatory Sciences on behalf of Earth Science Laboratories, Inc., submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting the establishment of exemptions from the requirement of a tolerance. EPA Announces Appointment of David Cash as Regional Administrator for EPA Region 1
Environmental Protection Agency (EPA) Administrator Michael S. Regan announced that President Biden has appointed Dr. David Cash to become EPA’s Regional Administrator for Region 1. Dr. Cash will lead the implementation of the Biden-Harris environmental agenda in Maine, New Hampshire, Vermont, Massachusetts, Rhode Island, Connecticut and in 10 Tribal Nations. EPA Announces Selection of 11 Organizations to Receive $2 Million to Help Tackle the Climate Crisis Through Food Diversion
The U.S. Environmental Protection Agency (EPA) announces the selection of 11 organizations expected to receive a total of approximately $2 million in funding to divert food waste from landfills by expanding anaerobic digester capacity nationwide. Anaerobic digestion (AD) is a process in which microorganisms break down organic materials, such as food scraps, manure, and sewage sludge, in the absence of oxygen. The process produces biogas, which can be captured and used for energy production, and digestate, a nutrient-rich product used for fertilizer.

EPA has received a specific exemption request from the Florida Department of Agriculture and Consumer Services (FDACS) to use the insecticide clothianidin (CAS No. 210– 880–92–5 as a soil drench application to treat up to 125,376 acres of immature (3–5 years old) citrus trees to control the transmission of Huanglongbing (HLB) disease vectored by the Asian Citrus Psyllid (ACP). The applicant proposes a use that has been requested in 5 or more previous years. Therefore, EPA is soliciting public comment before making the decision whether or not to grant the exemption. Pesticides; Certification of Pesticide Applicators; Further Extension to Expiration Date of Certification Plans
The Environmental Protection Agency (EPA) is proposing to extend the deadline by which Federal, State, territory, and tribal certifying authorities with existing certification plans are required to revise their existing certification plans to conform with the updated Federal standards for the certification of applicators of restricted use pesticides (RUPs) up to but not longer than November 4, 2024. Federal, State, territory, and tribal certifying authorities with existing certification plans are required to revise their existing certification plans to conform with the updated Federal standards for the certification of applicators of RUPs and the regulations established the deadline by which the existing plans are set to expire unless the revised plans are approved by the Agency. EPA is proposing this extension to allow additional time for proposed certification plan modifications to continue being reviewed and approved by EPA without interruption to Federal, State, territory, and tribal certification programs or to those who are certified to use RUPs under those programs. On Jan. 14, 2022, Judge Greg Kays of the Western District of Missouri issued an order appointing a receiver to take control of facilities owned by defendants HPI Products Inc., St. Joe Properties LLC, and William Garvey, after the defendants repeatedly failed to comply with a 2011 settlement intended to resolve alleged longstanding violations of state and federal environmental laws. Fluridone; Pesticide Tolerances for Emergency Exemptions
This regulation establishes time-limited tolerances for residues of the herbicide fluridone including its degradates and metabolites in or on peanut and peanut, hay. This action is in response to EPA’s granting of an emergency exemption under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) authorizing use of the pesticide on peanut. EPA’s Food Recovery Challenge Awardees Showcase Ways to Tackle Largest Category of Waste in Landfills
The U.S. Environmental Protection Agency (EPA) recognizes notable achievements and innovations of 18 businesses and organizations that participated in EPA’s Food Recovery Challenge (FRC) in 2020 and 2021. During this period, FRC partners prevented about 1.2 million tons of food from entering landfills or incinerators, saving $61.5 million in avoided landfill costs and reducing the amount of wasted food contributing to landfill emissions associated with climate change.

EPA Renews Enlist Product Registrations with New Control Measures, Providing Growers with Certainty for the 2022 Growing Season
EPA is issuing seven-year registrations for two herbicide products, Enlist Duo and Enlist One, to ensure growers have access to effective pesticide tools for the 2022 growing season. The new product labels, which incorporate robust control measures to protect non-target plants and animals, meet Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) standards and comply with the Endangered Species Act (ESA).
January 2022 Pesticide Registration Requests, Actions, and Tolerance Updates
- Pesticides; Expansion of Crop Grouping Program VI
The Environmental Protection Agency (EPA) is proposing revisions to its pesticide tolerance crop grouping regulations, which allow the establishment of tolerances for multiple related crops based on data from a representative set of crops. EPA is proposing amendments to Crop Group 6: Legume Vegetables; Crop Group 7: Foliage of Legume Vegetables; Crop Group 15: Cereal Grains; and Crop Group 16: Forage, Fodder and Straw of Cereal Grains. EPA is also proposing amendments to the associated commodity definitions. This is the sixth in a series of planned crop group updates expected to be prepared over the next several years. The Environmental Protection Agency (EPA) has submitted an information collection request (ICR), NESHAP for Pesticide Active Ingredient Production (EPA ICR Number 1807.10, OMB Control Number 2060–0370), to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act. This is a proposed extension of the ICR, which is currently approved through March 31, 2022. Public comments were previously requested, via the Federal Register, on April 13, 2021 during a 60-day comment period. This notice allows for an additional 30 days for public comments. A fuller description of the ICR is given below, including its estimated burden and cost to the public. An agency may neither conduct nor sponsor, and a person is not required to respond to, a collection of information unless it displays a currently valid OMB control number. (January 28)
